Americans with Disabilities Act

 

All agencies receiving Section 5310 or 5311 funding must maintain an up-to-date Title VI Plan. This plan must be formally approved by the agency’s governing body to be considered complete. Agencies are responsible for ensuring nondiscrimination based on race, color, or national origin in their programs and services. Additionally, all Title VI-related materials, including complaint forms and public notices, must be accessible in languages that reflect the current Limited English Proficiency (LEP) populations served. If demographic shifts occur, agencies must update translations and signage accordingly for both office locations and vehicles.

Alcohol and Drug Compliance

 

All transit agencies are required to have an updated Drug and Alcohol Policy on file (as of Jan. 2024). Two policy options are available: a zero tolerance policy (recommended) or a second chance policy (allowed but more burdensome for agencies).

 

To submit or make updates to your policy, complete your chosen policy, obtain approval from your governing body and submit both the policy and proof of approval to Sarah Soula at sarah.soula@nebraska.gov.

 

 

Civil Rights / Disadvantaged Business Enterprise (DBE)

 

All agencies receiving Section 5310 or 5311 funding must maintain an up-to-date Title VI plan. This plan must be formally approved by the agency’s governing body to be considered complete.

 

Agencies must ensure that translated Title VI documents (e.g., complaint forms, notices) match the current Limited English Proficiency (LEP) populations they serve. If local demographics change, forms and signage must be updated accordingly in both offices and vehicles.
